Section 15
Admission Defined
THE STATUTE
Original Text
An admission is a statement, oral or documentary or contained in electronic form, which suggests any inference as to any fact in issue or relevant fact, and which is made by any of the persons, and under the circumstances, hereinafter mentioned.
Legal Commentary
BSA Section 15 is substantively identical to IEA Section 17. The admission framework — the hierarchy of admissions and confessions, the 'suggests any inference' width, the person-specific relevancy — is preserved unchanged.
The practical modernisation is in how electronic admissions are handled: WhatsApp messages, email chains, social media posts, and voice recordings are clearly admissions under BSA Section 15 read with Section 2's expanded 'document' definition, without requiring the interpretive gymnastics the IEA required. The admissibility of these electronic admissions is then governed by Section 57.
Questions & Answers
Yes — BSA Section 15 defines admission as any statement 'oral or documentary or contained in electronic form' suggesting an inference about a fact in issue. WhatsApp messages are electronic form. A WhatsApp message admitting a relevant fact is an admission under Section 15. Its admissibility as evidence is governed by Section 57 (electronic records) — a Section 57 certificate may be required.
