IPC Section 304B was enacted in 1986 in direct response to the epidemic of "kitchen fires" and bride burning in 1970s–80s India. It remains one of the most powerfully constructed provisions in Indian criminal law because of its statutory presumption — once the prosecution shows (1) death within 7 years of marriage, (2) under abnormal circumstances, and (3) dowry-related cruelty "soon before" the death, the court presumes the husband and his relatives caused the death. They must then rebut this. BNS Section 80 carries this entire framework forward unchanged. The Supreme Court in Kamesh Panjiyar v. State of Bihar (2005) clarified that "soon before" does not mean immediately before — a proximate and live link between the cruelty and the death is sufficient. The provision covers deaths by burns (classic "kitchen fire" dowry murder), bodily injury, and deaths "otherwise than under normal circumstances" — broad enough to cover suicides induced by dowry harassment. Note: BNS also places a companion "cruelty" definition in Section 86, which applies to the Section 85 (498A equivalent) charge that typically accompanies Section 80 prosecutions.
