Section 130

Maintenance of Vehicle in Good Condition

Control of Traffic
Fine: ₹500Compoundable: YesEndorsement: No
BARE ACT PROVISION

Legal Text

The driver of a motor vehicle in any public place shall — (a) carry the certificate of registration of the vehicle, a certificate of insurance, the certificate of fitness (for transport vehicles), the permit (for transport vehicles), and the driving licence; and (b) on being so required by a police officer in uniform, produce such documents for examination.

Simplified Explanation

Section 130 creates the practical obligation to carry essential vehicle documents and produce them when demanded by a police officer. The documents required: (1) Certificate of Registration (RC); (2) Certificate of Insurance; (3) Driving Licence; (4) Certificate of Fitness (only for transport vehicles); and (5) Permit (only for transport vehicles). The 2019 Amendment transformed this provision by extending digital acceptance — all five documents can now be carried and shown in digital form through DigiLocker or the mParivahan app. A police officer cannot insist on physical documents if valid digital copies are shown. Failure to carry or produce documents is a Section 177 violation (₹500). However, the Section 130 obligation to produce documents operates independently of whether the documents are actually valid — if police discover the documents are not valid (expired insurance, suspended RC), the separate violations for those substantive offences apply.

Historical Context

Section 130 document checks are one of the most common forms of traffic enforcement in India — both as routine compliance checking and as pretext stops for more substantive investigation. The digital acceptance of documents under the 2019 Amendment reduced the practical impact of routine physical document checks.

Critical Changes

Digital documents (DigiLocker, mParivahan) legally valid for all five required documents — 2019 Amendment.

Police cannot insist on physical documents if valid digital copies are shown.

PUC certificate added to recommended carry documents (though not explicitly in Section 130).

Practical Scenarios

"A private car driver who left their RC at home — Section 130/177 violation, ₹500 fine (unless shown digitally)."
"A bus driver without the fitness certificate — Section 130/177 violation, ₹500 fine."
"A driver who shows all documents on DigiLocker — fully compliant, no violation."

Common Queries

Under Section 130: (1) Driving Licence, (2) Registration Certificate (RC), (3) Insurance Certificate, and for transport vehicles also: (4) Certificate of Fitness, (5) Permit. All documents can be carried digitally on DigiLocker or mParivahan.
No — since 2019, digital copies of all required documents on DigiLocker or mParivahan are legally equivalent to physical documents. Police cannot insist on physical originals if a valid digital version is shown.
A transport vehicle driver (taxi, auto, bus, truck) must carry all five documents: driving licence, RC, insurance certificate, fitness certificate (FC), and permit. Private vehicle drivers need only the first three.
