Registration of Motor Vehicles
Fine: N/ACompoundable: N/AEndorsement: No
BARE ACT PROVISION
Legal Text
Section 54: A registering authority may cancel the registration of a motor vehicle — if the vehicle has been destroyed or has been permanently rendered incapable of use; or if the certificate of registration has been surrendered; or if the vehicle is a stolen vehicle. Section 55: A court by which the owner of a motor vehicle is convicted of any offence under this Act may, in addition to any other penalty, order cancellation of the certificate of registration of the vehicle.
Simplified Explanation
Sections 54 and 55 address the permanent cancellation of vehicle registration, distinguishing it from temporary suspension (Section 53). Section 54 covers administrative cancellation: (1) the vehicle is destroyed or totalled; (2) the RC is voluntarily surrendered (e.g., before selling for scrap); or (3) the vehicle is confirmed stolen (to prevent the stolen vehicle's registration from being used for fraud). Section 55 provides courts with the power to cancel a vehicle's registration as an additional punishment upon conviction for a serious MVA offence — a significant deterrent for serious offenders. The vehicle registration cancellation under Section 199A (underage driving) is a specific application: when a juvenile causes an offence, the vehicle's registration is cancelled and cannot be re-registered in the juvenile's name until they reach 25.
Historical Context
Registration cancellation under Section 55 was rarely used before the 2019 Amendment, which brought increased focus on deterrence. The Section 199A amendment — mandating registration cancellation when vehicles are used by juveniles — represents the most significant expansion of this power.Critical Changes
Section 199A (2019 Amendment): vehicle registration cancelled when used by juvenile in offence — cannot be re-registered in juvenile's name until age 25.
Vehicle Scrapping Policy (2021) — voluntary surrender of RC for old vehicles under Section 54, with financial incentives.
Practical Scenarios
"A vehicle written off after a major accident — owner can surrender RC under Section 54 for administrative cancellation."
"A court convicting an owner for multiple serious traffic offences — may additionally cancel registration under Section 55."
Common Queries
Suspension (Section 53) is temporary — the vehicle can be brought into compliance and the suspension removed. Cancellation (Section 54) is permanent — the registration ceases to exist and the vehicle cannot be used unless re-registered (if eligible).
Yes — under Section 54, you can surrender the RC voluntarily, typically when scrapping the vehicle. This is encouraged under the Vehicle Scrapping Policy 2021 which provides financial incentives for voluntary de-registration and scrapping of old vehicles.
