Legal Text

Section 124: No motor vehicle shall be driven in any public place if the vehicle, including its equipment or any load, exceeds the prescribed dimensions. Section 125: No load which is likely to cause danger, nuisance or undue inconvenience to other users of the road or to property shall be carried. Section 126: No person other than the persons specified in this section shall be carried in a goods carriage.

Simplified Explanation

These three sections address the safety problems created by oversized, improperly loaded, and misused goods vehicles. Section 124 prohibits vehicles exceeding prescribed length, width, or height limits — over-dimensional cargo (ODC) vehicles carrying transformers, wind turbine blades, or other exceptionally large loads require special permits. Section 125 prohibits carrying loads that create road hazards — unsecured loads, loads with sharp projections, loads with no rear lighting or reflectors at night. Section 126 restricts who may travel in goods carriages — only the driver, cleaner, and person travelling in charge of the goods. No unauthorised passengers may travel in the load area. Section 194C imposes a fine of ₹1,000 per unauthorised passenger carried in a goods vehicle — directly targeting the practice of transporting workers, farm labour, and passengers in goods vehicles without proper passenger vehicle permits.

Historical Context

Passenger transport in goods vehicles is a major source of accident fatalities — particularly for migrant workers and agricultural labour transported between fields and villages. The 2019 Amendment's specific penalty (₹1,000 per person) and its connection to the tragedy of accidents involving workers in truck beds drives enforcement.

Critical Changes

Section 194C added — ₹1,000 per unauthorised passenger in goods vehicle.

ODC permit system standardised for over-dimensional loads.

Load securing requirements strengthened under 2019 Amendment.

Practical Scenarios

"A truck carrying 15 construction workers to a site — Section 126/194C violation: ₹15,000 fine."
"A flatbed truck carrying a long steel beam projecting 3 metres without proper lighting at night — Section 125 violation."

Common Queries

No — Section 126 prohibits carrying any person other than the driver, cleaner, and person in charge of goods in a goods carriage. The penalty under Section 194C is ₹1,000 per unauthorised passenger.
Yes — vehicles carrying over-dimensional cargo (ODC) that exceeds prescribed length/width/height limits require special movement permits from the State Government and NHAI (for national highways). These loads must travel during prescribed hours with escort vehicles.
